Projektowane zmiany w regulacji prawnej planowania przestrzennego w Polsce w świetle Europejskiego Zielonego Ładu
2022
Grounds for Asylum in the United Kingdom: Legal Materials, Case Studies, and Reflections from the Perspective of a County of Origin Expert
2019
This book is intended as a guide and support for legal practitioners in the field of asylum law. Each case-study deals with topics that, though extremely specific, relate to broader issues that country of origin experts often deal with: religious freedom, human slavery, integrity of the person, sexual orientation and gender identity. These topics are presented in a practical, clear and schematic manner, each chapter organised in a distinct, almost diagrammatic way, to make the reader familiar with the structure that typically characterises country of origin reports - the medium that is most used by experts - a structure that necessarily is concise and crisp.

L’ammissibilità ratione personae dei ricorsi alla Corte europea di individui estremamente vulnerabili: uguaglianza sostanziale e tutela del diritto d…
2021
The legal framework governing proceedings before the ECtHR does not deal with cases in which victims of human rights violations are not de jure and/or de facto capable of lodging applications with the Court. In the effort of overcoming such a procedural lacuna, the Court has established a test that, taking into consideration the extreme vulnerability of the victims (such as minors and persons with disabilities) and the seriousness of the alleged violations, allows NGOs to apply as their ‘de facto representatives’, provided that some other conditions are fulfilled. The Court’s approach, however, has not been always consistent and does not guarantee predictability and legal certainty. Moreove…
The European Union policies on access to justice and ADRs: good intentions are not enough as “the way to hell is paved with...”.
2014
Forms of extra-judicial dispute resolution are widespread in legal systems belonging to the western legal tradition and in the systems based on religion and tradition. With regard to the study this article refers to, cultural movements spreading and promoting ADR models have found place in legal systems based on the rule of law over the past fifty years, although with the necessary distinctions of institutional and, before that, socio-cultural nature. In a first phase, the European Union opened a broad debate to sensitize public awareness on the issues concerning the access to justice, the reduction of time and costs of a trial if compared to those when using ADRs, the respect of the weak p…
Bringing the child's procedural rights before the ECtHR through interpretative tools : access to justice, participation and representation
2020
The legal framework governing proceedings before the European Court of Human Rights (ECtHR) neither guarantees access to justice for children nor is it a child-sensitive procedure. Indeed, it does not allow for a direct hearing for children, nor does it provide them with an independent representative in cases of potential or actual conflict of interests. However, the Court has recently proved more conscious of such loopholes, and there is a trend towards the overcoming of such issues. The present contribution analyses this trend and justifies it by resorting to the interpretative reference to different international conventions, to the procedural rules of other international courts and trib…
